DUI Illinois Laws

Dui Illinois laws are strict for a reason; the state is cracking down on Drunk Driving.  This is an outline of what you could be facing if convicted of a DUI.

Driving Drunk is no longer tolerated in any state, and Illinois is leading the pack.  To start with, a Dui Conviction can change your life forever.  It can equate to steep fines, suspension of driving privileges, mandatory education classes, and prolonged jail time.   If you are convicted more than twice, your third offence will be considered a felony.

Being over the legal blood alcohol content (BOC)in IL is anything greater than a .08% BOC.  If you are pulled over and arrested with a BOC greater that .08%, you will be prosecuted and you will need a good Dui Lawyer as your first course of action.

DUI Illinois Laws in brief:

  • 1st Offense Conviction – Fines to $2,500.  Jail terms up to 1 year.  Driver’s license revoked for 1 year.
  • 2nd Offense Conviction  – Fines from $600 to $10,000.  Jail terms up to 2 years.  Driver’s license revoked for 5 year.
  • 3rd Offense Conviction – Considered a felony.  Fines up to $25,000.  Jail terms up to 3 years.  Driver’s license revoked for 10 year.
  • 4th  Offense  Conviction – Considered a felony.  Fines up to $25,000.  Jail terms up to 3 years.  Driver’s license permanently revoked.

Being convicted of DUI in IL will activate two different court proceedings.  The first can include the penalties, fines and jail time part of the conviction.  The second set of court procedures will be for the driver License Suspension and this second step needs to be acted upon in a timely manner if you wish to have your lawyer argue against this for you.  

Entering the courtroom by yourself in either one of these two procedures is not in your best interest.  You will be facing some stiff penalties and in order to minimize them to your best advantage, you will need legal consol.  Not knowing the DUI Illinois Laws can mean the difference of thousands of dollars, time behind bars and loss of driving privileges.
